TERMS AND CONDITIONS
- General Information
This document governs the terms and conditions for the use of the www.Finances-Education.com website (hereinafter referred to as “Terms and Conditions”) and sets out the conditions under which any person can access and use the content of the website, as well as the conditions that apply to reports legal issues that arise between www.Finances-Education.com and the User, by the User placing an Order in order to purchase the products provided by www.Finances-Education.com.
The Terms and Conditions below are applicable between the parties and have the value of an agreement between the User and the company Sc Ingraf Booking S.R.L. or other associated or collaborating companies of it that identify the economic agent (hereinafter referred to as “www.Finances-Education.com”), www.Finances-Education.com being the owner of the Site.
Any user of the Site has the obligation, before visiting or using the pages of the Site, to carefully read and study the Terms and Conditions, as well as the Policy on the protection of personal data and confidentiality (hereinafter “Privacy Policy) and Cookie Policy (hereinafter referred to as “Cookie Policy”).
If the Visitor or User does not agree and does not accept these Terms and Conditions, they are asked to leave the Site, stop using it and do not place an Order. Continuing to browse the Site and placing an Order implies the express, full and unconditional acceptance of these Terms and Conditions, the Privacy Policy and the Cookies Policy, as well as the expression of agreement regarding their content.
Finances.Education assumes and reserves the right to make any changes regarding the provisions of the Terms and Conditions, the Privacy Policy and the Cookies Policy, in a discretionary manner, as well as to delete or add any information, to suspend or discontinue use of the Site or any part thereof, at any time and without any prior notice, and the Visitor or User of the Site agrees and accepts this provision.
www.Finances-Education.com may publish information regarding various promotions or discounts practiced in certain periods of time, by it or by any other third party with which it has concluded partnership contracts or is in collaborative relationships. The products that are the subject of any promotion or campaign are subject to the terms and conditions of that promotion as presented on the Site or on the social media pages associated with www.Finances-Education.com and are supplemented by these Terms and Conditions. Any promotions presented are valid only for the duration and within the limit mentioned in the announcements regarding the campaigns carried out, either on the Site or on the associated social media pages.
- Who are we?
We are Sc Ingraf Booking S.R.L., a Romanian legal entity, with registered office in Cluj Napoca, Str Bucegi 13-15, Cluj County, registered at the Commercial Register under no. J12/1909/2019, having CUI 36251003, email: developer@finances.education. The notion of www.Finances-Education.com may also include other associated or collaborating legal entities that identify the economic agent.
- Definitions
Within these Terms and Conditions, unless expressly provided otherwise, the phrases mentioned below will have the following meanings:
- Conditions for placing an order and using Products
- In order to be able to legally place an Order for the purchase of Products or to be able to conclude any other type of contract for the purpose of affiliate marketing, it is necessary that the User: (i) be at least 18 years old and/or have full legal capacity or be represented or have the consent or authorization of the legal representative; (ii) provide true, correct, complete and up-to-date contact information; (iii) expressly and unconditionally accept these Terms and Conditions.
- The User shall refrain from placing a false or fraudulent Order, www.Finances-Education.com reserving the right to cancel the Order otherwise and to take appropriate legal action.
- www.Finances-Education.com reserves the right to block the access and/or account of any User who violates these rules or who does not comply with the conditions and manner of collaboration established in the case of marketing affiliation, for a fixed or indefinite period, without any prior notification, such as and to address the competent authorities in order to repair the possible damage suffered.
- The user understands and undertakes to comply with the prohibition of multiplication, use or distribution, in whole or in part, of the Product, as well as the prohibition of its use outside the purpose for which it was sold, own education of the buyer, without the prior written consent of www.Finances-Education.com.
- The User acknowledges, understands, expressly accepts and undertakes not to access the Products provided “The Wise Investor” and “The World Class Investor” by using or maintaining the account login, simultaneously, for more than two devices. The user understands that he is not allowed to communicate his account identification data (username and password) for use by a third party.
- We inform you that our technical team has the possibility to check and observe the number of devices used to access the account. In situations where suspicious activity is identified on a User’s account,www.Finances-Education.com reserves the right to adopt additional protective measures.
- The commercial sale, resale or distribution of any of the Products purchased from www.Finances-Education.com is prohibited.
- By placing an Order, the User accepts and expresses his consent to the form of remote communication used by www.Finances-Education.com in carrying out operations.
- If we believe that the request for the Products may have an illegal or immoral purpose, we reserve the right to refuse the supply of the respective product and to immediately inform the User about this refusal.
- Order, contract and affiliate marketing program
- The data and information provided on the Products presentation page do not constitute an offer from www.Finances-Education.com, but an invitation to offer.
- The order can only be placed online, by selecting the Product that the User wishes to purchase. After selecting the desired Product, the Order will be placed through the order page, where the following information will be provided:
- a) order data: name, surname, e-mail address
- b) payment method: by selecting one of the options indicated and filling in the bank card data.
By placing the Order, the User confirms that all the data provided is correct, complete and real. In the case of purchasing “The Wise Investor” and “The World Class Investor” Digital Products, the User will create an account with a password to access it.
The affiliate program in which a User can sign up assumes that he can obtain a commission, in the percentage established and communicated in advance by www.Finances-Education.com, either on the Site or on the associated social media pages, in the situation where other individuals will purchase Products provided by www.Finances-Education.com by using a link or code assigned to each User who is a member for affiliate marketing.
Users who become affiliates for marketing purposes of www.Finances-Education.com, will be able to benefit from the commission paid as a result of the promotion of the Products or social media pages associated with www.Finances-Education.com, either by way of a partial refund of the Price paid, in case certain conditions are met, either by paying the related amount under a contract concluded later, with the applicationand the terms and conditions stipulated within it, as will be established by mutual agreement between the parties.
In the case of “The Wise Investor” and “The World Class Investor” Products, the affiliate marketing commission is paid to the affiliate for each new member registered in the academy as a result of using the affiliate’s link, after a period of 1 (one) month . The term of 1 (one) month is the minimum period that any new member of the academy must reach, regardless of whether he used the affiliate link to purchase the ebook.
In order to identify and correct errors that occurred when entering data, the User has at his disposal the electronic address of www.Finances-Education.com, in order to report and correct erroneously provided data.
If, for any reason, the Order cannot be processed, this fact will be brought to the attention of the User as soon as possible.
We reserve the right in our absolute discretion and without having to give a reason, to refuse to accept an offer to purchase one or more Products. In such situations, no contract will be concluded between the parties and we will have no liability.
We reserve the right to withdraw or block, at any time, the Products advertised on the Site for purchase and/or any other information related to them.
We reserve the right to cancel an Order placed, in case of justified reasons, among which we can mention:
- suspicion of fraud;
- failure to make payment;
- non-acceptance of the Transaction by the issuing bank of the User’s card;
- invalidation of the Transaction by the card processor;
- the provision by the User of some incomplete or erroneous data;
- www.Finances-Education.com’s reasonable suspicion that the User is pursuing an illegal purpose or that he may cause any kind of damage to www.Finances-Education.com or its affiliates or collaborators;
- non-observance of the Terms and Conditions in this document.
The contract between the parties will be concluded when the payment is made by the User through electronic means of payment, meaning the moment when the www.Finances-Education.comaccount has been credited with the amount paid by the User. In the case of the illustrative eBook offered free of charge, the contract between the parties will be concluded at the moment the Product distributed by www.Finances-Education.com is actually delivered to the User.
Any money collected from payments made on the basis of orders that could not be processed or fulfilled, for any reason, will be refunded by www.Finances-Education.com to the User.
6. Price, method of payment, renewal and cancellation of subscription
- Price and method of payment
The price of the products is expressed in Euros and is not subject to value added tax. The prices shown are final, and transactions are processed in “RON”, at the exchange rate of the User’s bank, regardless of the currency of the account from which the payment is made.
The price for all Products provided shall be paid by the User in advance.
www.Finances-Education.com reserves the right to change or update the Price of the Products at any time, such update superseding any other price previously displayed for that product.
In the event that the Price or any other details related to the Products were displayed, for any reason, erroneously in the presentation, www.Finances-Education.com will inform by e-mail the User who placed an Order under these conditions, in the shorter time from the moment the error was detected.
www.Finances-Education.com does not require additional payments, but is not and cannot be held responsible for any additional costs incurred by the User over the Price of the Product purchased, including, but not limited to, transfer or currency conversion fees, applied by the bank issuing the User’s card, in the situation where the card issuing currency is different from the currency in which the sale is made.
www.Finances-Education.com will issue and send the User an invoice for the purchased Product, in electronic format, to the e-mail address provided by the User, the purchase price shown on the invoice being the same as the price shown on the Site at the time of purchase. If the User wants a personalized invoice based on the data of the purchasing entity, he will inform www.Finances-Education.com about this and provide all the information legally required for issuing the invoice.
Payment for the products can be made by money order or by payment with a bank credit or debit card, at the time of placing the online Order, through the Twispay payment processor. If paying by bank card, the Transaction will appear on the account statement under the name www.Finances-Education.com.
Online payment is made in complete security, with the personal card or the card of the purchasing company, and the cards accepted for payment are those issued under the logos VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV2/CVC2 code) .
Bank card data is processed exclusively on Twispay servers. Information security is guaranteed by the fact that Twispay sends your confidential card data encrypted to the processing bank via a secure connection.
- Delivery and Transfer of Property
The delivery of the Product will be made after the conclusion of the Contract, after the successful processing of the payment made by the User, by means of electronic mail to the e-mail address indicated by the User at the time of placing the Order and/or by creating the account to access the Products “The Wise Investor” and “The World Class Investor, as well as to all other related groups.
The account can be opened by providing the necessary data, such as e-mail address and password, in the dedicated section of the Site or by accessing the sections indicated in the e-mails sent, according to the instructions existing at the time.</p >
The delivery of the Product is carried out only online, in electronic format, so in the case of Digital Products, only a non-exclusive and unlimited license is received, the ownership remaining with us or our collaborators or affiliates.
- Copyright and Intellectual Property
The entire content of our Website and Products, as well as all copyrights on them, represent intellectual property and belong to www.Finances-Education.com – SC Ingraf Booking Srl or our suppliers, giving us the right to use them, they being protected according to Law no. 8/1996 on copyright and related rights.
Any content, including but not limited to trademarks, graphics, web graphics, drawings, text, scripts, static or dynamic images, logos, audio, video and any other data, represents the intellectual property of www.Finances-Education.com or its suppliers and for any violation of rights arising from it, www.Finances-Education.com reserves the right to refer to the competent courts, in order to fully recover the damage caused, as well as to file any complaint proves to be necessary before the judicial bodies, in order to hold the perpetrator accountable.
The User is prohibited from copying, publishing, distributing, multiplying, modifying, transferring to third parties, altering, improperly using the Products and any element of their content, as well as, if applicable, removing copyright marks of www.Finances-Education.com on the products or participating in any way in the transfer, sale, distribution of materials made by copying, modifying, displaying or reproducing the components of the Products, unless it has received the written, express and prior consent ofwww.Finances-Education.com . Otherwise, www.Finances-Education.com reserves the right to recover any damages suffered as a result of the actions described above, whether direct, indirect, present or future.
Permission to use the provided Product is granted to a single User, who has the opportunity to access the account created for this purpose. The account can be acceper User, simultaneously, only from two devices. When you are provided with online access to the material contained in the Product, you are granted a revocable, non-exclusive, non-transferable, perpetual license to use the Product provided. You are not granted the right to record by video or audio methods or by other means, the content of the Product provided.
The names, images and logos and marks identifying www.Finances-Education.com or third parties and their products and services are subject to the copyrights, design rights and trademarks of www.Finances-Education.com and/or third parties. Nothing contained in these Terms and Conditions shall be construed as granting any license or right to use any trademark, design right or copyright belonging to www.Finances-Education.com or any third party.
The User acknowledges and agrees that, neither by transmitting the Product provided, nor by handing over the right to access the Product provided, there is no transfer of any intellectual property rights regarding the ideas, concepts, methods, graphics, solutions or trademarks contained in the Product and which are the exclusive property of www.Finances-Education.com or third parties.
- Responsibility and Limitation of Liability
The content of the Products does not represent a financial or fiscal consultation or training, as regulated by the legal provisions, but a guide on economic-financial education. In the case of the various campaigns promoted by www.Finances-Education.com, that information is provided without www.Finances-Education.com being responsible for the actions or behavior adopted by a User following the information provided.
www.Finances-Education.com products contain a set of materials, which can be both written and audio-video and can include illustrated and practical courses, illustrative images, graphics, guides, informative documents, practical and concrete exercises, access to meetings , coaching and other information related to economic education, financial independence and investments.
www.Finances-Education.com has taken all necessary care to create complete, correct Products that contain real and accurate information regarding the financial and economic aspects presented in them. However, www.Finances-Education.com does not make any representation, promise or warranty as to the accuracy, correctness or completeness of the Content of the Products or any obligation of result or diligence with respect to the materials, documents and/or content thereof and expressly excludes liability for any cost, loss or damage suffered as a result of the use of the Products, as well as any intended that the Product provided fully satisfy the needs of each User.
www.Finances-Education.com assumes no responsibility for any person acting on their own as a result of the information contained in the Products provided or the opinions expressed in the courses presented or in the coaching sessions and cannot be held responsible for any damage that could be suffered by a User by using the purchased Products, the purpose of the provided Products being brought to the attention of www.Finances-Education.com, that of the type of generl financial information.
- Disclaimer of Warranty
All the information used to describe the Products (including, but not limited to, static or dynamic images, descriptive text, graphic or audio-video presentations) do not impose any obligation on our part, they have an exclusive role of presentation and information .
The user understands, accepts and agrees that in the case of electronic or digital products that require immediate access, it will not benefit from a legal guarantee, in accordance with the provisions in force.
However, since www.Finances-Education.com wants to have permanently satisfied users, it may implement a special guarantee policy for certain digital products, in the sense that it may return the sums paid by the User, in whole or in part, in a certain term and subject to certain conditions. The exact conditions for the reimbursement of the amounts paid are indicated in the chapter dedicated to this section within these Terms and Conditions.
- User’s Right of Withdrawal/Refund
- Non-existence of the right of withdrawal
The user understands and accepts that they do not automatically benefit from the right of withdrawal. By accepting these Terms and Conditions, the User gives his prior and express consent and confirms that he has become aware of the fact that he will lose his right of withdrawal, in accordance with the legal provisions in force applicable to contracts concluded at a distance, as well as with regard to consumer rights in the framework of the contracts concluded with professionals, included in the GEO no. 34/2014, which provides that the provision of digital content, which is not delivered on a physical medium, is exempt from the right of withdrawal.
Nevertheless, www.Finances-Education.com may decide, in its free judgment and discretion, that it will refund certain sums of money, in whole or in part, in particular cases and in compliance with the conditions mentioned, but this fact does not in any way attract liability or the obligation to proceed in such manner on a constant basis.
- 14 day refund policy
With respect to the terms and conditions provided in this section, if the User is not satisfied with the Product purchased from www.Finances-Education.com, the latter undertakes and undertakes to refund the money received.
The deadline for refunding money is 14 calendar days from the moment www.Finances-Education.com is informed of the User’s decision to withdraw from the Contract.
The return of “The Wise Investor” and “The World Class Investor” digital products, purchased by the User, is possible only with respect to a period of 14 calendar days, which runs from the moment of the processed payment, during which the User must express in writing the intention to obtain a refund, except in the situations mentioned below.
The term in which the User may be eligible to express his intention to obtain a refund is 14 calendar days, if the purchase of any Digital Product was made without using any discount code, and 7 calendar days in the situation where the purchase of any Digital Product was made by using a discount code belonging to another User registered in our affiliate program or any other discount code offered on the site or on social media platforms by www.Finances-Education.com. This assumption only applies if a friend or acquaintance recommends one of our Digital Products to you and you purchase such Product using that person’s code.
The term in which the User can express his intention to obtain a refund may also be different depending on the situation in which the User purchases a Digital Product during the period when www.Finances-Education.com is running a Prize Campaign. As such, please check the “www.Finances-Education.com Campaigns” section at the end of these Terms and Conditions to find out if such a campaign is in progress and what conditions apply in this situation, or follow the current information posted on the social media associated with www.Finances-Education.com regarding that campaign.
To request a refund, the User must send an email to www.Finances-Education.com at developer@finances-education.com, including the name, request for refund and reason for requesting the refund, or use the messaging systems existing on social media pages belonging to www.Finances-Education.com for the communication of said information.
The essential condition for the return of the Product purchased by the User: “The Wise Investor” and “The World Class Investor” to be possible, is that the pdf document is not downloaded from “my account”.
After the expiration of the 14 calendar day period or the periods mentioned as exceptions, the User is no longer eligible, regardless of the progress made with respect to the course, and cannot receive any kind of refund.
Regarding the Product purchased by the User in the form of an illustrative course provided in .pdf format, reimbursement will only be possible in the amount of 50% of the amount paid, given that the digital material will remainin the possession of the User, without the actual return being possible in optimal and real conditions. In this situation, www.Finances-Education.com reserves the discretionary right to refuse a refund request, if the User does not provide a concrete and pertinent motivation regarding the option expressed.
In the case of returning the Digital Products “The Wise Investor” and “The World Class Investor, the User will automatically lose access to any courses, to the platform, to any private groups, to webinars, coaching sessions , prize draws and other such benefits offered by www.Finances-Education.com, the User’s account will be deleted.
- Additional explanations for common situations
We draw attention to the fact that the download of the pdf document “The Wise Investor” and “The World Class Investor, attracts ineligibility for reimbursement of the amounts paid. We assure you that you will have sufficient content and information to decide whether you want to keep the Products or not.
We reasonably consider that the refund cannot be accepted in the case of a User who has downloaded the pdf document in terms of “The Wise Investor” and “The World Class Investor, as the possibility of refund in such situations would imply actually giving away our Products for free.
We hereby inform you that our technical team has the ability to easily access the progress made by a User regarding the Digital Product we have provided.
The conditions mentioned in this section regarding the refund in the case of the purchase of “The Wise Investor” and “The World Class Investor” Products, as well as regarding the partial refund in the case of the purchase of the Product in the form of the illustrative course, are also determined by the fact that www.Finances-Education.com in turn pays registered affiliates, so it may not be possible to pay an affiliate commission in full to an affiliate if the person they referred to provide a www.Finances-Education.com product requests a refund.
- Data Protection and Privacy
The parties declare that they are aware of and respect the Romanian and European legislation regarding the protection of personal data in the conduct of economic activities, including, but not limited to, European Directive no. 95/45/CE regarding GDPR Regulation no. 679/2016, with subsequent amendments.
Aspects related to the confidentiality and processing of personal data, at the time of placing an Order and purchasing the Product provided, as well as in the case of concluding other agreements or contracts, are governed by the Privacy Policy, which is an integral part and which completes these Terms and Conditions. Please read the entire content of the Privacy Policy carefully.
Part of the purposes for which Finances.Education collects data or requests the User to provide personal data, may be: a) to make possible the delivery of the ordered Products; b) to confirm the Order; c) to inform the Users regarding the status of the Order; d) for concluding other agreements, contracts or collaborations; e) to fulfill legal obligations; f) for providing answers to the notifications, reports or complaints made; g) marketing and advertising purposes; h) sales monitoring purposes and User behavior and others.
www.Finances-Education.com informs Users that certain information regarding their personal data may be disclosed upon request and within the limits provided by law, to various competent bodies of the State, such as Prosecutors, Police, courts and others.
By accepting these Terms and Conditions, the User declares that he accepts that his personal data may be included in the database of www.Finances-Education.com and expressly consents to his personal data provided being stored, used and processed in the purpose and limits set forth in the Privacy Policy, by www.Finances-Education.com and its collaborators or affiliates, but also to be assigned or transto its affiliates, as well as to other entities in the country or abroad, based on a confidentiality commitment from them and in compliance with the relevant legislation.
The parties undertake and guarantee to maintain the confidentiality of the Confidential Information made available, including for their employees, agents, collaborators or affiliates, preventing their disclosure to unauthorized third parties, as well as using them only for the purposes envisaged in this document. An exception to these provisions is the use of data for purposes authorized in advance and in writing by the Parties and subject to the terms established by them.
The parties agree that all inventions, know-how, business, commercial, performance information regarding the Products, technical and financial or any information specifically designated as confidential or that may reasonably be considered reasonably believed to be confidential, without being expressly marked as such, disclosed by one Party to the other Party, constitutes Confidential Information and belongs to the Party making the disclosure.
Not subject to this section, not being considered Confidential Information, those which:
- are or have become public, without any intervention by any of the Parties;
- are made available to the Parties on a non-confidential basis, from external sources and which have not been subject to the prohibition of disclosure;
- are known by one of the Parties prior to the communication of the information by the other Party and without any obligation of confidentiality;
- are requested pursuant to and with the permission of the law, within certain judicial procedures, by various competent authorities in the matter.
The User confirms that he will not disclose the Confidential Information and/or Product Content to any other person, except where necessary to fulfill certain obligations, except where he is required by the law in force to disclose . Otherwise, www.Finances-Education.com reserves the right to proceed against the User to recover any damages caused as a result of the unauthorized disclosure.
- Notices, Complaints and Referrals
The user expressly accepts that all communications and notifications made on the basis of or in connection with this Agreement will be mediated by electronic mail, to the address communicated by him at the time of placing the Order or by using the existing messaging systems on social media pages belonging to www.Finances-Education.com and the User with whom the communication is made.
The user has the possibility to formulate notifications, complaints and notifications regarding the Order placed and/or the Product delivered, to the following e-mail address: contact@Finances-Education.com
Complaints will be resolved by www.Finances-Education.com within 30 (thirty) days of their receipt.
Proof of communication from us can be made by simply proving that www.Finances-Education.com sent the communication to the User.
- Force majeure
None of the parties is liable for failure to perform on time and/or improper performance, in whole or in part, of any of its obligations under these Terms and Conditions (except for payment of the Price), if the failure to perform or improper performance or with delay was caused by force majeure. Force majeure, as an unforeseen event and beyond the reasonable control of one of the Parties, having the definition given by the Romanian legislation in force, includes, but is not limited to, acts or acts of the government or of the public or local authorities, pandemics, state of war, acts of terrorism, natural disasters, nuclear accidents, acts of hackers or internet service providers.
If, within 15 days of its occurrence, the respective event does not cease, the Parties have the right to notify their full termination of the contract, without any other additional formality, without the intervention of the courts and without any of them claiming damagesres to the other.
- Termination of Agreement
Obligations and liability of the Parties that became due or were performed prior to termination shall survive termination. These Terms and Conditions are effective unless and until either Party decides that it wishes to terminate the agreement.
You have the possibility to request the termination of the agreement at any time by formulating a notice informing us that you no longer wish to use the purchased Products and/or use our Site. Cancellation of subscriptions is carried out in the manner indicated in the relevant chapter of this document.
If, in our reasonable opinion, we discover that, or suspect that you have not complied with any term or provision of these Terms and Conditions, we may refuse access to the Products provided and may terminate this agreement.
In the event of termination, for any reason, of the agreement and these Terms and Conditions, the liability and limitation clauses, warranty disclaimer, intellectual property rights and confidentiality will continue to have effect.
- Assignment and Transfer
All products provided by us under these Terms and Conditions are of nominal value, are personal to you and are not transferable or assignable to any other person.
Finances.Education has the right to assign these Terms and Conditions to any other company without prior notice.
Finances.Education reserves the right to transfer, assign, strike, subcontract or otherwise dispose of the Contract or any of its rights and obligations under the Contract to any third party at its discretion.
- Applicable Law and Jurisdiction
- This contract, the Terms and Conditions presented, as well as their entire content, are governed and interpreted in accordance with Romanian law in force.
- These Terms and Conditions, as well as their content, comply with the relevant legislation and consumer protection rules, in which they were drawn up taking into account Law no. 365/2002 on electronic commerce, of Law no. 296/2004 regarding the Consumer Code, of Government Ordinance no. 21/1992 on consumer protection, of Government Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts, as well as GDPR Regulation no. 2016/679 on the protection of personal data.
- The parties agree that any misunderstandings or disputes arising in connection with the concluded agreement shall be resolved amicably.
- To the extent that resolving disputes amicably is not possible, disputes that may result from any procedure, misunderstanding or request of the Parties and/or that may arise from the relationship between the Parties, contractual or otherwise, will be submitted for resolution by the competent Romanian courts in the Municipality of Bucharest.
- NEWSLETTER
The user has the possibility to sign up to receive the Newsletter from www.Finances-Education.com. By signing up, she expresses her express and full consent to receive periodic e-mails.
